Waqf War: Supreme Court to Review Controversial Amendment Act in Landmark Case

Delhi, 5 May (H.S.): The Supreme Court is set to hear a series of petitions challenging the constitutional validity of the Waqf (Amendment) Act on Monday, May 5, 2025.

This comes after the government decided to put a pause on two key aspects of the controversial law, in light of questioning by the top court. On April 17, Solicitor General Tushar Mehta assured the court that waqf properties, including those used by non-Muslims, would not be denotified and no appointments would be made to the Central Waqf Council and boards until May 5.

The Centre strongly opposed the apex court’s suggestion of an interim order against denotification and inclusion of non-Muslims in the boards. The court then granted a week’s time for the Centre to respond to the petitions and set the next hearing for May 5.

The three-judge bench will also hear a petition filed by AIMIM chief Asaduddin Owaisi.

In its affidavit, the Centre defended the amended Act and opposed any blanket stay on a law passed by Parliament. It justified the provision for waqf by user properties, stating that interference would create a legislative void.
