Delhi High Court rejects Pakistani woman's plea for long term Visa in India

New Delhi, April 28 (H.S.): The Delhi High Court has refused to hear a petition filed by an Indian citizen demanding a long-term visa for his Pakistani wife, Sheena Naz. Justice Sachin Dutta’s bench clarified that there is no room for judicial intervention in matters related to national security.

Sheena Naz filed the petition seeking not to cancel her residence permit and to expedite the decision on her long-term visa application. Her residence permit was valid from March 26 to May 9. Sheena Naz is married to an Indian citizen. Following a terrorist attack in Pahalgam, the central government decided on April 24 to suspend visa services for Pakistani nationals and instructed everyone to leave India by April 27. In light of this decision, Sheena Naz approached the High Court to consider her visa application and not to suspend her residence permit, which is valid from March 26 to May 9.

The court stated that the central government’s decision was taken due to national security concerns and that there is no scope for judicial review in this matter. The court noted that there is no need for judicial review in the order issued under Section 3(1) of the Foreign Act, as it is motivated by serious national security reasons. There are no exceptions included within this order in the court’s jurisdiction.
