The petition states that not implementing the new education policy implemented by the central government by the state governments is not in the public interest and it affects the rights of citizens. The petition demands that guidelines be issued to the state governments to implement the new education policy. The petition states that all state governments except Tamil Nadu, Kerala and West Bengal have implemented the new education policy.

The petition states that the laws and schemes of the central government apply to all states. It is the duty of all state governments to do so. The petitioner has said that free education is a fundamental right given by the Constitution and in such a situation, by refusing to accept this scheme, the state government is depriving children of the fundamental right to free education.
