
New Delhi, March 04 (HS): The Supreme Court, while hearing the demand for a quick decision on the disqualification of MLAs who left BRS and joined Congress in Telangana, has issued a notice to the Speaker of the Telangana Legislative Assembly, Telangana Government, Election Commission and the concerned MLAs. A bench headed by Justice BR Gavai ordered the next hearing of the case on March 25.
The BRS party’s petition states that 10 MLAs who contested the 2023 assembly elections on BRS tickets later joined the Congress. The Speaker of the Telangana Legislative Assembly is taking a lot of time to decide on the disqualification petitions filed in this regard. During the hearing on February 10, the Supreme Court had said that the rights of parties cannot be abolished in a democracy. The court had asked the Speaker of the State Legislative Assembly to decide on the applications filed for disqualification within a stipulated time frame.
During the hearing, the court had said that we respect the two other pillars of democracy, but this does not mean that the purpose of the law of Parliament is not successful. The court had directed the Speaker to tell by when he will decide on these applications. The court asked the lawyer appearing on behalf of the Assembly Speaker to also bring instructions on whether the appropriate time means till the end of the assembly session. In this case, the Telangana High Court had directed the Speaker of the Assembly to take a decision on the matter of disqualification of the MLAs soon.
